Terms of Service for Feeds iOS App

Welcome to Feeds! These Terms of Service (“Terms”) govern your access to and use of the Feeds iOS application (the “App”), provided by Feeds (“we,” “us,” or “our”). By accessing or using the App, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not use our App.
1. Acceptance of Terms
By creating an account and using the Feeds App, you confirm that you have read, understood, and agree to be bound by these Terms, as well as any additional terms and conditions or policies referenced herein or made available through the App. These Terms constitute a legally binding agreement between you and Feeds.
2. User Accounts and Registration
To access certain features of the App, you are required to create an account. We use Frontegg, a proprietary identity and access management software solution, as a Platform and Service Provider for user authentication and authorization. When you register, we receive anonymized tokens of your user identity through iOS or Google Single Sign-On (SSO) options. You are not required to use your real name for your account handle. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
3. User Conduct and Content Restrictions
a. Feed Naming and Content
Users can name personal and collaborative feeds within the App. However, you agree that feed names and any other user-generated content or interactions must not include anything that is hateful, lewd, racist, offensive, defamatory, infringing, or otherwise objectionable. We reserve the right, in our sole discretion, to rename any feed or terminate your account if we determine that a feed name or content violates these Terms or applicable laws.
b. Prohibited Activities
You agree not to engage in any of the following prohibited activities:
• Scraping or Data Mining: Accessing, collecting, or storing any part of the App or its content for commercial or unlawful purposes, including using any robot, spider, scraper, or other automated means to access the App.
• Reverse Engineering: Attempting to decipher, decompile, disassemble, or reverse engineer any of the software or code comprising or in any way making up a part of the App.
• Interference with Services: Interfering with or disrupting the integrity or performance of the App or the data contained therein.
• Illegal Content: Posting, transmitting, or otherwise making available any content that is unlawful, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, invasive of another’s privacy, hateful, or racially, ethnically, or otherwise objectionable.
• Unauthorized Access: Attempting to gain unauthorized access to the App or its related systems or networks.
• Malware: Uploading or transmitting viruses, worms, Trojan horses, or any other type of malicious code that will or may be used in any way that will affect the functionality or operation of the App.
• Impersonation: Impersonating any person or entity, or falsely stating or otherwise misrepresenting your affiliation with a person or entity.
4. Intellectual Property Rights
a. Our Intellectual Property
All intellectual property rights in the App, including but not limited to copyrights, trademarks, service marks, logos, and proprietary algorithms, are owned by Feeds or its licensors. You acknowledge and agree that the App and its content are protected by copyright, trademark, and other laws of the United Arab Emirates and foreign countries. You agree not to remove, alter, or obscure any copyright, trademark, service mark, or other proprietary rights notices incorporated in or accompanying the App.
b. Third-Party Content and Fair Use
The App may display content, including images, text, and trademarks, that are owned by third parties. This content is displayed on a fair use basis, similar to a search engine, to show content and redirect users to external platforms where the content is hosted. All such third-party content remains the property of its respective owners, and we make no assertion to any rights beyond fair use for their inclusion in the service. Your use of such third-party content is subject to the terms and conditions of the respective owners.
5. Data Collection and Privacy
Your privacy is important to us. Our collection, use, and disclosure of your personal information are governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the App, you consent to such collection, use, and disclosure in accordance with our Privacy Policy. We collect information about your interactions with feeds, including likes, dislikes, scheduled content, reminders, and items removed from your feeds. We also collect device and usage data, such as IP addresses and device information, through RudderStack, a Service Provider and Data Processor. For more details, please refer to our Privacy Policy.
6. Service Availability and Modifications
We reserve the right to modify, suspend, or discontinue the App (or any part thereof) at any time, with or without notice. We will not be liable to you or to any third party for any modification, suspension, or discontinuance of the App. We may also impose limits on certain features and services or restrict your access to parts or all of the App without notice or liability.
7. Disclaimers and Limitation of Liability
a. Disclaimers
THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. YOUR USE OF THE APP IS SOLELY AT YOUR OWN RISK.
b. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL FEEDS, ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE APP; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE APP; (III) ANY CONTENT OBTAINED FROM THE APP; AND (IV) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE, AND EVEN IF A REMEDY SET FORTH HEREIN IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE.
OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE APP, REGARDLESS OF THE FORM OF THE ACTION, IS LIMITED TO THE AMOUNT PAID BY YOU, IF ANY, FOR ACCESSING OR USING THE APP.
8. Indemnification
You agree to indemnify, defend, and hold harmless Feeds, its affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys’ fees) that such parties may incur as a result of or arising from your (or anyone using your account’s) violation of these Terms.
9. Governing Law and Dispute Resolution
a. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United Arab Emirates, without regard to its conflict of law principles.
b. Arbitration
Any dispute, controversy, or claim arising out of or relating to these Terms, including the breach, termination, or validity thereof, shall be finally settled by arbitration. The arbitration shall take place in Dubai, UAE, and shall be conducted in English. The decision of the arbitrator(s) shall be final and binding on both parties.
c. No Class Actions
YOU AGREE THAT YOU MAY BRING CLAIMS AGAINST FEEDS ONLY IN YOUR INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. Unless both you and Feeds agree, no arbitrator or judge may consolidate more than one person’s claims or otherwise preside over any form of a representative or class proceeding.
10. Changes to These Terms
We may revise these Terms from time to time. The most current version will always be posted on our website and within the App. If a revision, in our sole discretion, is material, we will notify you (for example, via email to the email address associated with your account). By continuing to access or use the App after revisions become effective, you agree to be bound by the revised Terms.
11. Miscellaneous
These Terms, together with the Privacy Policy, constitute the entire agreement between you and Feeds regarding your use of the App. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
